Data transmitted by browser/internet technology

You can visit our website without providing any personal information. Your visit to our website will be logged. The IP address currently used by your PC, the Internet provider, place, date and time, the browser type and operating system of your PC, the terms of the search engine search and your surfing behaviour on the pages you view on our website are recorded. It is also recorded whether and from which external site, via which social media link or via which search engine a visitor arrives at our website. Insofar as we make use of service providers to carry out and process processing, the contractual relationships are regulated in accordance with the provisions of the General Data Protection Regulation (DSGVO).

Data protection for applications

SHL Versicherungsmakler GmbH collects and processes personal data from applicants in the application process for an employment relationship. In addition to personal data (name, address, contact details), this includes information on qualifications and training as well as other data provided to SHL Versicherungsmakler GmbH in connection with the application. Processing also takes place electronically, especially if an applicant applies by e-mail, via an application form or via an Internet portal and submits his or her application documents in this way. If the person responsible concludes an employment contract with the applicant, the data transmitted will be stored for the purpose of handling the employment relationship. If no employment relationship is concluded with the applicant, the application documents will be deleted six months after notification of the rejection decision, unless other legitimate interests of SHL Versicherungsmakler GmbH stand against it. This could, for example, constitute a burden of proof in proceedings under the General Equal Treatment Act (AGG).

Rights of the parties concerned

No automated decision in individual cases

According to Art. 22 DSGVO, data subjects have the right not to be subject to an exclusively automated decision - including profiling - which has legal effect or significantly affects them. This shall not apply where the decision is necessary for the conclusion or performance of a contract between the data subject and the data controller, where the decision is taken with the express consent of the data subject or where the decision is permitted by law and contains appropriate measures to safeguard the rights, freedoms and legitimate interests of the data subject.

If the person concerned wishes to assert rights based on an automated decision, he or she can contact the data protection officer of SHL Versicherungsmakler GmbH.

Right to information

The data subject has the right to request confirmation from the data controller as to whether personal data concerning him or her are being processed; if this is the case, he or she has a right of access to such personal data and to the following information:
  • the processing purposes;
  • the categories of personal data being processed;
  • the recipients or categories of recipients to whom the personal data have been or are still being disclosed, in particular recipients in third countries or international organisations;
  • if possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration;
  • the existence of a right of rectification or deletion of personal data concerning him or of a restriction on processing by the controller or of a right of opposition to such processing;
  • the existence of a right of appeal to a supervisory authority;
  • if the personal data are not collected from the data subject, all available information on the origin of the data;
  • the existence of automated decision-making, including profiling in accordance with Article 22(1) and (4) and, at least in these cases, meaningful information on the logic involved and the scope and intended impact of such processing on the data subject.

Right to correction

The data subject shall have the right to request the controller to rectify any inaccurate personal data concerning him/her without delay. In view of the purposes of the processing, the data subject has the right to request the completion of incomplete personal data, including by means of a supplementary declaration.

Right to cancellation

The data subject shall have the right to require the data controller to delete personal data concerning him/her without delay and the data controller shall be obliged to delete personal data without delay if one of the following reasons applies:
  • The personal data are no longer necessary for the purposes for which they were collected or otherwise processed.
  • The data subject shall withdraw the consent on which the processing referred to in Article 6(1)(a) or Article 9(2)(a) was based and there is no other legal basis for processing.
  • The data subject shall oppose processing in accordance with Article 21(1) and there are no overriding legitimate grounds for processing or the data subject shall oppose processing in accordance with Article 21(2).
  • The personal data have been processed unlawfully.
  • The deletion of personal data is necessary to fulfil a legal obligation under Union law or the law of the Member States to which the data controller is subject.
  • The personal data have been collected in relation to information society services provided in accordance with Article 8(1).

If a data subject wishes to have his stored data deleted by SHL Versicherungsmakler GmbH for one of the aforementioned reasons, he may contact our data protection officer or another employee of the data controller. The data will then be deleted immediately. If the personal data have been made public by SHL Versicherungsmakler GmbH and is SHL Versicherungsmakler GmbH obliged as the entity responsible to delete this data pursuant to Art. 17 para. 1 DSGVO, it shall take appropriate measures, including technical measures, taking into account the available technology and the implementation costs, to inform other persons responsible for data processing who process the published personal data, that the data subject has requested that all links to this personal data or copies or replications of this personal data be deleted by these other persons responsible for data processing, insofar as processing is not necessary.

The above paragraphs on the right to cancellation shall not apply where processing is necessary
  • to exercise freedom of expression and information;
  • for the performance of a legal obligation required for processing under the law of the European Union or of their Member States to which the controller is subject or for the performance of a task in the public interest or in the exercise of official authority conferred on the controller;
  • on grounds of public interest in the field of public health in accordance with Article 9(2)(h) and (i) and Article 9(3) DSGVO;
  • for archiving purposes of public interest, scientific or historical research purposes or for statistical purposes referred to in Article 89(1) DSGVO, where the right referred to in paragraph 1 is likely to render impossible or seriously prejudicial the attainment of the objectives of such processing, or
  • to assert, exercise or defend legal claims.

Right to limitation of processing

The data subject has the right to require the controller to restrict processing if one of the following conditions is met:
  • the accuracy of the personal data is disputed by the data subject for a period which enables the data controller to verify the accuracy of the personal data,
  • the processing is unlawful and the data subject refuses the deletion of the personal data and instead requests a restriction on the use of the personal data;
  • the data controller no longer needs the personal data for the purposes of processing, but the data subject needs them for the purpose of asserting, exercising or defending legal claims, or
  • the data subject has lodged an objection to the processing referred to in Article 21(1) DSGVO until it has been established whether the data subject's legitimate reasons outweigh those of the data subject.

If one of the aforementioned conditions is fulfilled and the data subject wishes to request the restriction of personal data stored at SHL Versicherungsmakler GmbH, they can contact the data protection officer of SHL Versicherungsmakler GmbH or another employee. The restriction of the processing will then be initiated immediately.

Right to data transferability

The data subject has the right to receive the personal data concerning him/her which he/she has provided to a controller in a structured, current and machine-readable format and to transmit this data to another controller without interference by the controller to whom the personal data have been provided, provided that
  • processing is based on a consent pursuant to Article 6(1)(a) or Article 9(2)(a) or on a contract pursuant to Article 6(1)(b) DSGVO, and
  • processing is carried out using automated methods.

In exercising his/her right to data transferability under paragraph 1, the data subject shall have the right to have the personal data transferred directly by a data controller to another data controller, where technically feasible.

Right of objection

The data subject shall have the right to object at any time to the processing of personal data relating to him/her on the basis of Article 6(1)(e) or (f)DSGVO  for reasons arising from his particular situation, including profiling based on those provisions. In the event of an objection, SHL Versicherungsmakler GmbH will no longer process personal data unless it can prove compelling grounds for processing that outweigh the interests, rights and freedoms of the data subject or the processing serves to assert, exercise or defend legal claims.

If personal data have been processed by SHL Versicherungsmakler GmbH for direct advertising purposes, the data subject has the right to object at any time to the processing of personal data concerning him/her for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct advertising.

If the data subject objects to processing for direct marketing purposes, the personal data will no longer be processed for these purposes.

The data subject shall have the right to object to the processing of personal data relating to him/her for scientific or historical research purposes or for statistical purposes in accordance with Article 89(1) for reasons arising from his particular situation, unless such processing is necessary for the performance of a task in the public interest.

The objection may be lodged by the person concerned with the data protection officer of SHL Versicherungsmakler GmbH or another employee of the person responsible. The data subject is also free to exercise his/her right of opposition in connection with the use of information society services by means of automated procedures using technical specifications, notwithstanding Directive 2002/58/EC.

Right to revoke consent under data protection law

Any person affected by the processing of personal data has the right to revoke consent to the processing of personal data at any time.

If the data subject wishes to exercise his/her right to withdraw his/her consent, he/she may contact our data protection officer or another employee of the controller at any time.

Right of appeal to a supervisory authority

Without prejudice to any other administrative or judicial remedy, any data subject shall have the right of appeal to a supervisory authority, in particular in the Member State where he resides, works or is alleged to have infringed, where the data subject considers that the processing of personal data concerning him or her is contrary to this Regulation (DSGVO).

So-called social bookmarks (e.g. from Facebook, Twitter and Xing) are integrated on our website.
